HassleFree Legal – Refund and Cancellation Policy

HassleFree Legal Technologies Private Limited ("HassleFree", "Platform", "We") values transparency and fairness. This Refund and Cancellation Policy ("Policy") sets out the conditions under which a User ("You") may cancel a booking or request a refund for services booked through the Platform.

This Policy forms part of and must be read together with the Terms and Conditions of the Platform. In the event of any inconsistency between this Policy and the Terms and Conditions, the Terms and Conditions shall prevail.

This Policy is published in compliance with Rule 4 of the Consumer Protection (E-Commerce) Rules, 2020 and Section 47 of the Consumer Protection Act, 2019. Nothing in this Policy limits or excludes any rights you may have as a consumer under applicable law.

1. General Principles

  • HassleFree is a technology intermediary and marketplace platform, not a law firm. Services are delivered by independent Advisors who are solely responsible for service quality and delivery.
  • Refunds and cancellations depend on the service type, service delivery status, and the validity of the claim.
  • All refund requests must be submitted to support@hasslefree.legal within 7 calendar days of the disputed transaction or service completion date, whichever is earlier.
  • Approved refunds will be credited to the original payment method used at the time of booking within 7 working days of approval, in accordance with Clause 7 of the Terms and Conditions.
  • Government fees, court filing fees, stamp duty, and all other third-party statutory charges paid as part of a service are non-refundable once incurred, regardless of cancellation.
  • Payment gateway processing fees may be deducted from refund amounts where such fees are non-recoverable by HassleFree.

2. Cancellation by User

2.1 Before Service Commences

A service is considered commenced when the Advisor accepts the booking or begins work on the matter, whichever is earlier.

  • Cancellation made at least 24 hours before the scheduled appointment or before the Advisor has begun work: full refund, less any non-recoverable payment gateway fees.
  • Cancellation made less than 24 hours before the scheduled appointment: refund of up to 75% of the booking value. A cancellation fee of up to 25% of the booking value applies.
  • Cancellation after the Advisor has begun work but before delivery of any output: partial refund at HassleFree's discretion, based on the stage of work completed.

2.2 After Service Commences

  • Where a document has been drafted, an opinion delivered, a filing submitted, or an appearance made, no refund will be issued for the work already completed.
  • Where only part of a service has been completed, a proportionate partial refund may be considered at HassleFree's discretion, based on documented evidence of work completed by the Advisor.

2.3 No-Show and Non-Response

  • If a User fails to attend a scheduled consultation without prior cancellation, no refund will be issued.
  • If a User fails to provide required documents or information within 7 days of a booking despite reminders, the service will be treated as completed by the Advisor for the purposes of this Policy, and no refund will be issued.

2.4 Urgent Services

  • For urgent services including bail applications, habeas corpus petitions, and other time-critical matters where work commences within hours of booking, no refund is available once the Advisor has begun work.
  • Cancellation of an urgent service must be communicated immediately to support@hasslefree.legal and through the Platform.

2.5 Subscription Services

  • For monthly or quarterly subscription retainer services, cancellation may be made at any time with effect from the next billing period.
  • No refund will be issued for fees already paid for the current billing period unless the Advisor has failed to perform the agreed service within that period.

3. Cancellation by Advisor

  • If an Advisor cancels a confirmed booking or fails to deliver the service within the committed timeline without valid justification, the User will receive a full refund of the booking fee including any platform facilitation fees.
  • HassleFree will offer to reassign the matter to another Advisor of comparable qualifications at no additional cost to the User. The User may accept reassignment or elect to receive a full refund.
  • If an Advisor's licence or registration lapses and they are consequently delisted from the Platform during an active engagement, the User will receive a full refund or reassignment.

4. Refund Eligibility

4.1 Refunds Are Applicable in the Following Circumstances

  • The Advisor fails to deliver the service within the committed timeline without acceptable justification.
  • The Advisor commits professional misconduct, malpractice, or a material breach of the Advisor Agreement.
  • Duplicate payment due to a technical error on the Platform.
  • The service delivered is materially different from the service description at the time of booking.
  • Cancellation made at least 24 hours before the scheduled appointment in accordance with Section 2.1 of this Policy.

4.2 Refunds Are Not Applicable in the Following Circumstances

  • Dissatisfaction with the legal opinion, strategy, or advice given by the Advisor, provided the service was actually delivered.
  • Refund request made after the service has been completed and accepted by the User.
  • The User provided false, forged, incomplete, or misleading documents.
  • The User failed to cooperate or attend appointments.
  • Adverse legal outcome does not qualify for refund.

5. Refund Process

To request a refund, the User must:

  • Submit a written refund request to support@hasslefree.legal or through the Platform dashboard within 7 calendar days of the disputed transaction or service completion date, whichever is earlier.
  • Include the Booking ID, the reason for the refund request, and all supporting documents or evidence.

HassleFree's process on receipt of a refund request:

  • Acknowledgement of the request within 48 hours with a tracking reference number.
  • Review of the request within 5 to 7 business days. HassleFree may contact the Advisor and the User for additional information during this period.
  • Communication of the decision to the User within 14 working days of receipt of the complete request.
  • Processing of approved refunds within 7 working days of the decision, credited to the original payment method.

Refunds will be processed in accordance with RBI guidelines applicable to online payment transactions. The time taken for the refunded amount to reflect in your account may vary depending on your bank or payment provider.

6. NRI and Foreign Currency Refunds

  • Where payment was made in a foreign currency (GBP, USD, AED, or CAD), the refund will be credited in the same currency where technically feasible, or in INR at the exchange rate prevailing on the date of refund processing.
  • Any exchange rate difference arising between the date of payment and the date of refund is not the liability of HassleFree.
  • All foreign currency refund transactions are subject to applicable FEMA provisions and Reserve Bank of India regulations.

7. On-Site Visit Cancellations

  • Cancellation of a confirmed on-site visit must be communicated at least 4 hours before the scheduled visit time through the Platform or by email to support@hasslefree.legal.
  • Cancellation with at least 4 hours notice: full refund of the on-site service fee, less any non-recoverable travel costs already incurred by the Advisor.
  • Cancellation with less than 4 hours notice or no-show: no refund of the on-site service fee. The Advisor' travel and time costs are treated as incurred.
  • Advance payments for urgent on-site visits including jail visits and police station visits at odd hours are non-refundable once the visit has been confirmed and the Advisor has set out.

8. Dispute Resolution

If a User is not satisfied with HassleFree's decision on a refund request:

  • The User may escalate the matter to the Grievance Officer at grievance@hasslefree.legal. The Grievance Officer will acknowledge the complaint within 24 hours and endeavour to resolve it within 15 days of receipt, in accordance with Rule 3(2) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
  • If the dispute is not resolved through the Grievance Officer within 15 days, the User may appeal to the Grievance Appellate Committee (GAC) constituted under Rule 3A of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, at sancharsaathi.gov.in/grievance.
  • Nothing in this Policy prevents a User who qualifies as a consumer under the Consumer Protection Act, 2019 from approaching the appropriate Consumer Disputes Redressal Commission at any stage, independently of any internal resolution process.

HassleFree's internal review decision is an administrative determination for Platform operations only. It does not constitute a binding legal adjudication and does not prevent you from seeking any legal remedy available under applicable law.

9. Amendments to This Policy

  • HassleFree reserves the right to modify this Policy at any time to reflect changes in law, platform operations, or service categories.
  • Updated versions will be published on the Platform with a revised Last Updated date.
  • For material changes, HassleFree will provide at least 14 days advance notice by email or prominent platform notification.

10. Governing Law

This Policy is governed by the laws of India, including the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Indian Contract Act, 1872, and the Information Technology Act, 2000, as amended from time to time. Subject to the arbitration clause in the Terms and Conditions, any dispute arising in connection with this Policy shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana.
